TERMS & CONDITIONS

The Pattern Affiliate Program is a way to incentivize you to spread the word on Pattern. It’s a referral program, where you get compensation by check or credits based on product sales. We reserve the right to change the terms of this program at any time.

If at any time, in Pattern’s sole discretion, we believe that you (Affiliate, Publisher and/or Advocate) are not promoting Pattern or our product in a reasonable, clear, or legal manner, we will terminate this relationship immediately.

Pattern, Patternbodywash.com and Pattern LLC are interchangeable.
Affiliate, Publisher and Advocate are interchangeable.

Display Advertising & Email Marketing

Pattern encourages affiliates to use Pattern’s display advertising (“creatives”) in educational and entertaining content & through email marketing. We want you to succeed in these high-value branding and sales related activities. Pattern appreciates simplicity, quality, design and knowledge.

Affiliate Domain Names and URLs

Affiliate websites must have a unique URL (including sub domain and URL path) and may not use Pattern brand names or any misspellings or variations of our name, including but not limited to Restricted Keyword and Domain Name Lists.

Search Engine Marketing

Pattern allows affiliates to use Search Engine Marketing (both paid and natural) in their promotional campaigns. However, Pattern prohibits all Affiliates from bidding on the Pattern brand name or misspellings for search engine positioning. This notification applies to, but is not limited to, the attached Pattern trademarks, brand names, and product names including variations.

Affiliate agrees not to bid on terms in the Restricted keyword list, including the Pattern or patternbodywash.com name (or any common misspelling or confusingly similar name) on any pay-for-placement search engine, including, but not limited to, Google, Yahoo! Search Marketing, Bing, MSN, Ask.com, and AltaVista. Contextual marketing is prohibited unless approved by Pattern in writing in advance.

Affiliate agrees not to use the Pattern brand name or Patternbodywash.com in the display URL or display copy in search engines.

Affiliate also agrees to use the Restricted Keyword and Domain Name List as a broad negative match on all paid search initiatives

Affiliates may not use the Pattern name, or any variation thereof, directly or indirectly in (a) metatags, (b) title tag, (c) hidden text, page titles or source code, and/or (d) the Affiliate's domain or sub-domain. Affiliates may not purchase and/or use any URLs that contain any trademarks or trade names of Pattern bodywash.com, including without limitation the name Pattern bodywash.com, or any common misspellings or mistyping of any of the foregoing. Furthermore, Affiliates may not use domain names incorporating trademarks or variations of names for companies deemed as competitors.

Pattern may, in its sole discretion, at any time amend, modify, change, alter, add or delete any words. It is the Affiliate’s obligation to remain informed of any change to the Restricted Keyword List or Trademarked Domain List.

Coupons

Affiliates are not permitted to promote any coupons not provided by the Pattern Affiliate Program. If an Affiliate receives any violations of the foregoing prohibitions, it will be subject to termination at Pattern's sole discretion.

Commission

Pattern reserves the right to withhold sales commissions to affiliates or remove affiliates from the program that are found to be in violation of any of these policies.

Pattern does not pay commission on Gift Certificates or on the portions of orders purchased with credits, including but not limited to referral, courtesy and other non-monetary credits.

Program Participation

Prohibited Activities. In participating in the Program, Publisher will not engage in any unsuitable activities in connection with its Web site(s) on which it displays Links. Publisher may not: (i) in any way modify, redirect, suppress, or substitute the operation of any button, link, or other interactive feature of the Destination Site; (ii) make any orders or subscription requests, or engage in other transactions of any kind on the Destination Site on behalf of any third party, or authorize, assist, or encourage any other person or entity to do so; (iii) engage in any offline promotional, marketing, or other advertising activities on behalf of Pattern or in connection with the Destination Site, including by using any trademark of Pattern or its affiliates or any Link in connection with any offline promotion or in any other offline manner (e.g., in any printed material, mailing, email or attachment to email, or other document, or any oral solicitation)

Publisher may not in any manner misrepresent or embellish the relationship between Pattern and itself, or express or imply any relationship or affiliation between itself and Pattern or any other person or entity except as expressly permitted by this Agreement (including by expressing or implying that Pattern support, sponsor, endorse, or contribute money to any charity or other cause). Publisher may not issue any press release with respect to this Agreement or its participation in the Program.

In addition, and notwithstanding anything in this Agreement to the contrary, if at any time Pattern believes, in its sole discretion, that Pattern is or may become subject to tax collection requirements in connection with this Agreement or the activities performed by either party under this Agreement, Pattern may, upon written notice to Publisher, at its option, terminate all of its payment obligations under this Agreement or terminate this Agreement so long as Pattern terminates its agreements with other third parties that are situated similarly to Publisher (as determined by Pattern). If Pattern elects to terminate only its payment obligation under this Agreement, Publisher will have the right, as its sole and exclusive remedy, to terminate this Agreement on 30 days prior written notice to Pattern.

Pattern is not liable for any informational errors, incompleteness, or delays, or for any actions taken in reliance on information contained herein.
